Comments to Rule Review 150June 4, John D. Pringle has commented by letter on the Texas Department of Insurance, Division of Workers’ Compensation (DWC) rules review of rules 150.1, 150.2 and 150.3 which provide for standards of practice for attorneys in workers’ compensation, attorney disqualification and written authorization for adjustors to handle workers’ compensation claims. A portion of the comments from page 3 of the letter are set out below: An attorney in practice before the Division of Workers’ Compensation may be disqualified, after a hearing under Texas Labor Code section 415.034 from representing any party before the Division of Workers’ Compensation for the activities set out in this subsection. The Administrative Law Judge of the State Office of Administrative Hearings shall make the final Decision and Order at the conclusion of the hearing. The rules of the State Office of Administrative Hearings will apply to the hearing process except that Administrative Law Judge shall make the final Decision and Order and no Motion for Rehearing is required for any appeal to the District Court.
