Comments to Proposed URA Rules

John D. Pringle has commented by letter on the Texas Department of Insurance (TDI) proposed Utilization Review rules.  These comments are about the unannounced on-site visits by TDI staff to Utilization Review Agent offices.  

 

A portion of the comments from page 2 of the letter are set out below:

 

Unannounced on site visits to review operations and seize books and records of URAs violates the Texas Constitution’s Bill of Rights.   Because proposed rule 19.2014(g), authorizes unannounced on site visits to review operations and to seize books and records, it is unconstitutional, in my opinion.
