Comments to Informally Proposed new Chapter 180 Rules

John D. Pringle has commented by letter on the Texas Department of Insurance, Division of Workers’ Compensation (DWC) informally proposed rules 180.60, 180.62, 180.64, 180.66, 180.68, 180.70, 180.72, 180.74, 180.76, and 180.78.  These are new informally proposed DWC enforcement rules. 

 

A portion of the comments from page 3 of the letter are set out below:

 

Informally proposed rule 180.62(d)(4) is invalid.  Adoption of such a rule would conflict with the Texas Constitution, and Texas Government Code.  A state agency cannot waive the requirements of its own rules.  See Rodriguez v. Service Lloyds Ins. Co., 997 S.W.2d 248, 255 (Tex. 1999).
